DOT Invites Comments on Oral Fluid Drug Testing

The U.S. Department of Transportation is accepting comments on a proposed rule to allow the use of oral fluid testing in its regulated drug screening program. The objective is to give employers a choice that will help combat employee cheating on urine drug tests and provide a more economical, less intrusive means of achieving the safety goals of the program, according to a notice published in the Federal Register.

The proposal includes provisions to update other aspects of the department’s drug testing procedures and align with Mandatory Guidelines for Federal Workplace Drug Testing Programs Using Oral Fluid established by the U.S. Department of Health and Human Services. Comments to the notice of proposed rulemaking are due March 30, 2022.
